No Refi Terms & Conditions

This offer applies only to first-lien mortgage refinance loans brokered by Dwell Mortgage and is not valid for subordinate, simultaneous, or HELOC closings. Reverse mortgage loans are not eligible. The offer waives only the lender fee charged by the lender/investor the client chooses for their refinance  — typically called  underwriting. This offer does not cover discount points, mortgage origination, which can also be called originator compensation or any third-party charges such as processing, title, settlement, appraisal, credit report, commissions, or similar service fees. In plain english, this offer does not remove Dwell’s ability to charge and make profit on any refinance loan, nor charge valid third party fees Dwell has no control over. 

To qualify, you must have closed a previous first-lien mortgage (purchase) loan(s) brokered by Dwell Mortgage LLC on or after January 1, 2023, and at least six (6) months before submitting a new application.

Refinancing your existing loan may increase the total amount of interest you pay over the life of the loan. All loans are subject to credit and underwriting approval. Additional terms, conditions, and restrictions may apply. Contact us for full details.

  • Contractual prohibitions on using borrower data for AI model training, fine-tuning, or product development without Dwell Mortgage’s prior written consent

  • SOC-2 Type II certification or equivalent security standards where available

These providers may receive borrower information, which may include nonpublic personal information, solely for the purpose of providing their contracted services to Dwell Mortgage. They are distinct from general-purpose AI platforms.

General-Purpose AI Platforms

Dwell Mortgage does not input, transmit, or process nonpublic personal information through general-purpose AI platforms, consumer AI chatbots, or AI tools not specifically designed and contracted for mortgage industry use. Our website chat assistant operates on general, non-identifying information only. You are advised not to enter SSNs, full account numbers, or other NPI into any chat tool on this website.

AI in Marketing and Content

AI tools used for marketing, content creation, and social media do not access, process, or incorporate your personal loan file information. AI-generated content on this website is reviewed by Dwell Mortgage staff before publication.

DATA SECURITY

Dwell Mortgage maintains administrative, technical, and physical safeguards designed to protect your information from unauthorized access, use, or disclosure. These safeguards include written information security policies and procedures, access controls limiting employee access based on business need, encryption of sensitive data in transit and at rest, and contractual obligations on service providers to maintain appropriate safeguards.

DATA RETENTION

  • Loan application files (funded): retained for a minimum of three (3) years following loan closing, and up to seven (7) years, consistent with federal and state requirements and investor guidelines
  • Loan application files (withdrawn or denied): retained for a minimum of twenty-five (25) months consistent with ECOA and Regulation B requirements
  • Website inquiry information: retained for the period necessary to respond to your inquiry and for a reasonable period thereafter
  • Marketing and communication records: retained consistent with applicable TCPA and CAN-SPAM requirements

After the applicable retention period, information is securely destroyed or de-identified in accordance with our data destruction policies.

DATA BREACH NOTIFICATION

In the event of a data breach involving your personal information, Dwell Mortgage will notify affected individuals in accordance with applicable state data breach notification laws, including but not limited to Washington State (RCW 19.255.010), California (Cal. Civ. Code 1798.82), and the breach notification laws of all other states where we are licensed and operate. Clients and Coach

In this agreement, the term ‘Coach’ refers Dwell Mortgage LLC. and or it’s employees. In this agreement, the term ‘Client’ refers to any person or entity that purchases or uses the services or programs provided by Dwell Mortgage LLC.

Definition of Coaching

Coaching is a partnership (defined as an alliance, not a legal business partnership) between the Coach and Client, in a thought-provoking and creative process that inspires the client to access and maximize their personal potential. It is designed to facilitate the development of Dwell Mortgage LLC. shared or created skills and tools and to develop and carry out a plan for achieving those objectives.

Coaching Is Not Medical Advice

The Client understands and agrees that coaching services provided by Dwell Mortgage LLC. are not to be used as a substitute for professional advice by legal, medical, or other qualified professionals. It is the Client’s sole responsibility to seek professional guidance from qualified professionals as needed. By entering into an agreement with Dwell Mortgage LLC. the Client acknowledges and agrees to the terms of this clause regarding the limitations of coaching services provided by Dwell Mortgage LLC.

Recordings

Client understands that all Calls will be recorded, both video and audio. The recordings and any other materials prepared in the course of the production and distribution of the Calls become property of the Coach, and the Coach shall have the sole and exclusive right to use, exploit, and distribute such recording, throughout the world, in perpetuity. The Coach will limit exposure to the Client by not releasing the Client’s last name. The Client understands and agrees that he or she shall receive no compensation for the Client’s appearances on and participation in any of the recorded Calls.

Intellectual Property

Client acknowledge that the Coach is the owner or the licensee of all intellectual property rights and all other rights in the materials and content the Coach uses within the Call and all training sessions, both physical and online, and nothing in this Agreement or otherwise shall operate to transfer the ownership of the intellectual property rights in such material or content to the Client. You may not at any time copy, reproduce, publish in any form, share, sell, dispose of, or otherwise make available to a third party in any way any of the content or materials that the Coach uses or provides.

Limited Liability

Except as expressly provided in this Agreement, the Coach makes no guarantees, representations or warranties of any kind or nature, express or implied with respect to the coaching services negotiated, agreed upon and rendered. In no event shall the Coach be liable to the Client for any indirect, consequential, or special damages. Notwithstanding any damages that the Client may incur, the Coach’s entire liability under this Agreement, and the Client’s exclusive remedy, shall be limited to the amount actually paid by the Client to the Coach under this Agreement for all coaching services rendered through and including the termination date.

Recordings and Marketing Materials

By participating in our services, you acknowledge that Dwell Mortgage LLC. may record audio and/or video of sessions for marketing purposes. You grant us a non-exclusive license to use these recordings in marketing materials, including testimonials and promotional content. If you do not wish to be recorded or have your recordings used for marketing, please notify us in writing at support@dwellmtg.com before participating. We will provide notice when recording is taking place in jurisdictions requiring consent. Your continued participation constitutes consent.
